Analysis of Legislation to Require Motorcoach Retrofits and CDL’s for Van Drivers
Based on an analysis of the proposed legislation, many outfitter buses may not have to be retrofitted with seat belts if the proposed Motorcoach Enhancement Safety Act passes Congress. The requirement for a commercial drivers license (CDL) endorsement for 9 to 15 passenger van drivers of commercial motor vehicles crossing state lines is in both the House and Senate bill. The CDL requirement for 15 passenger vans will be a huge burden on many outfitters with significant interstate van fleets.
H.R. 1396 and its companion bill in the Senate, S. 554, the “Motorcoach Enhanced Safety Act of 2009 require seat belts in “motorcoaches” or “over-the-road buses” which is “a bus characterized by an elevated passenger deck located over a baggage compartment”. The legislation defines “bus” as “a motor vehicle with motive power, except a trailer, designed for carrying more than 10 persons.” Only over-the-road buses with elevated passenger decks over a baggage compartment will be required to have seat belts under the proposed law.
The legislation also increases the training and testing requirements for commercial drivers licenses.
